Terms of Service

1. Who we are
MoVal is operated by MoremiServ (Pty) Ltd (CIPC Reg. No. 2026/636788/07), a private company registered in the Republic of South Africa. Registered office: 21627 Dolphin Street, Lion Pride Lifestyle Estate, Nietgedacht, 1739, South Africa. Contact: info@moval.co.za or WhatsApp +27 78 448 4256.
2. Our role: a software platform
MoVal is a technology marketplace that connects households and businesses ("Clients") with independent, verified service professionals ("Professionals"). MoremiServ (Pty) Ltd is a software intermediary. It is not a Private Employment Agency under the Employment Services Act 4 of 2014 and not a Temporary Employment Service under section 198 of the Labour Relations Act. We do not employ, place, direct or supervise Professionals.
Each arrangement is concluded directly between the Client and the Professional using our agreement template. Rates must meet or exceed the National Minimum Wage, and arrangements must comply with the Basic Conditions of Employment Act and Sectoral Determination 7 for domestic workers, including notice periods.
3. Fees and payments
- A 10% Client Platform Convenience Fee applies to every booking for use of MoVal's technology: verified discovery, scheduling, digital contracts and payslips, and secure escrow payment processing. It is a software licensing fee, not a placement or recruitment fee under section 15 of the Employment Services Act, and is settled from the booking value with the Professional's written consent (BCEA s34(1)(a)).
- MoVal is not an insurer. The COIDA amount is charged to the Client, who is the registered employer. MoVal acts as administrative facilitator: it keeps earnings records and prepares COIDA (W.As.8) and UIF information. UIF is 2% (1% Client, 1% Professional).
- Clients see the full price before confirming a booking. Contract discounts are shown at booking and applied to the amount charged.
- Client payments are held through our payment provider in a settlement account kept separate from MoVal's operating funds, in trust for the Professional, until shifts are completed and paid out at month end with a digital payslip. Earned wages may not be withheld over unresolved disputes.
4. Verification — important notice
Verification is an administrative check, usually completed within 1 to 4 weeks, of identity and right to work, police clearance, proof of residence, qualifications, banking details and references, together with a personal interview, as at the date reviewed. It is not insurance, a fidelity guarantee or a warranty of future conduct.
5. Client responsibilities — important notice
- Clients direct the work, provide a safe workplace and any agreed equipment.
- Valuables: cash, jewellery and small high-value items must be locked away before a booking starts.
- Keys and access: physical keys, gate remotes and alarm codes are given at the Client's own risk. MoVal never holds custody of premises.
- Insurance: Clients should keep their own home and household-contents insurance.
- Health and safety (OHSA 85 of 1993): Clients must secure pets, provide gloves for harsh cleaning chemicals and may not require work at dangerous heights without safety equipment.
- Clients are the employer for COIDA and UIF purposes and must keep their registration current; this protects Clients from civil injury claims (COIDA s35).
- Ending an ongoing arrangement requires the notice required by the Basic Conditions of Employment Act and a fair process.
5A. Standard Domestic Services Agreement
When a Client confirms a booking and a Professional accepts it, they conclude the MoVal Standard Domestic Services Agreement (Client and Professional) directly with each other. The booking details in both dashboards form its written schedule of particulars (BCEA s29).
1. Parties
This agreement is concluded directly between the Client who confirms the booking and the Professional who accepts it. MoremiServ (Pty) Ltd t/a MoVal provides the software, template and payment processing only and is not a party, employer, labour broker or agency.
2. Particulars of the work (BCEA s29)
The workplace address, dates, start time, daily hours, service type and hourly rate are those shown on the confirmed booking in both parties' dashboards, which forms the written schedule to this agreement.
The hourly rate may never be below the National Minimum Wage. Ordinary hours may not exceed 45 per week; overtime is paid at 1.5 times, and Sunday and public-holiday work at the rates in Sectoral Determination 7. A meal break of at least one hour applies after five hours of continuous work.
3. Leave and notice
For ongoing arrangements, annual, sick and family-responsibility leave accrue under the BCEA. Either party may end an ongoing arrangement with one week's notice in the first six months, two weeks' notice up to one year and four weeks' notice thereafter, following a fair process.
4. Safety, keys and valuables
The Client provides a safe workplace under the Occupational Health and Safety Act 85 of 1993, including gloves for harsh chemicals, secured pets and no work at dangerous heights without safety equipment.
The Client secures cash, jewellery and valuables. Keys, remotes and alarm codes are given at the Client's own risk. The Professional may leave unsafe premises without losing wages already earned.
5. Statutory contributions
The Client is the employer for UIF and COIDA purposes. MoVal collects and records contributions as administrative facilitator under the Client's mandate.
6. Professional protections
- Professionals may leave unsafe premises or end a booking where they face harassment, discrimination or abuse, without losing wages already earned.
- Client addresses are verified before bookings proceed.
- Overtime, Sunday and public-holiday work, breaks and leave follow the BCEA and Sectoral Determination 7.
7. Cancellations and refunds
- Clients may cancel a booking free of charge up to 24 hours before the start time.
- A booking that is not cancelled at least 24 hours before the start time remains payable in full, and the Client is liable for that payment to fairly compensate the Professional.
- Clients may change a booking or reschedule its booking days instead of cancelling, subject to the Professional's availability.
- Refunds for unperformed services are processed to the original payment method. Your rights under the Consumer Protection Act and ECTA (including the cooling-off period where applicable) are not limited.
8. Accounts and conduct
You must give accurate information, keep your login secure and treat others with respect. We may suspend accounts for fraud, abuse or unlawful conduct.
9. Dispute resolution
Contact us first at info@moval.co.za; we aim to respond within 5 business days and can help mediate between Clients and Professionals. Unresolved employment matters may be referred to the CCMA; consumer complaints to the National Consumer Commission or relevant ombud.
10. Liability, indemnity and law — important notice
Claims for loss, damage or injury arising at a Client's premises lie between the Client and the Professional, and each indemnifies MoVal against claims caused by their own acts or omissions. To the extent the law allows, our liability is limited to platform fees received for the relevant booking. Nothing limits liability for gross negligence or rights that cannot be waived under the Consumer Protection Act. These terms are governed by South African law.
